The Department of Justice reminded the public of federal laws requiring individuals to register as foreign agents when acting in the United States at the direction or control of a foreign government or foreign principal.

The Department recognizes and protects First Amendment rights and stated it will not inhibit constitutionally protected free speech. At the same time, it committed to upholding FARA and 18 U.S.C. § 951 disclosure obligations.

Both citizens and noncitizens who act as agents of a foreign power to carry out public activity — including public demonstrations designed to further the propaganda or other goals of the foreign power — must register with or notify appropriate federal authorities. Failure may result in civil or criminal sanctions up to five years in prison.

Individuals with questions should consult legal counsel or seek an Advisory Opinion from the Department’s FARA Unit.
